Guarantee and Limitation of Liability

Every hydraulic unit is fully guaranteed against defects in workmanship or material. Within one year from the date of shipment to the original purchaser, any unit which has proven defective will be repaired without charge, F.O.B. Factory, when unit is shipped prepaid to factory. The Company is not responsible for any damage resulting from tampering, abuse, or incorrect application.

The Company’s liability on any claim of any kind, including negligence, for any loss or damage arising out of, connected with or resulting from the design, manufacture, sale, delivery, resale, installation or installation advice, inspection, repair, operation, or use, of any equipment described herein, shall in no case exceed the price allocable to the equipment which gives rise to the claim and shall terminate four years after the date of original shipment. The purchaser, by acceptance of any of the Company’s products described herein, assumes all liability of the consequence of the use of those products.

Returned Goods Policy

The charges below reflect the cost incurred by Deschner Corporation for returned items due to administration, paperwork and packaging.

When a unit is packaged and shipped, Deschner Corporation incurs costs due to administration, paperwork and packaging. These costs are included in the cost of the unit when it is sold and shipped to the customer. If the unit is returned, these costs are unpaid and additional costs are incurred due to unpacking, inspection, and paperwork, required to return the item to stock and to issue the credit to the customer. Due to product liability concerns, units that have been out of our facility must undergo special inspection, retesting, and sometimes disassembly before they can be returned to stock. It is our position that unless we have made some error to cause the return, the customer should have the responsibility to help defray these costs.

Any unit(s) returned must be authorized in advance with an RMA (Return Material Authorization) issued by Deschner Corporation.  Deschner Corporation will not accept or take any responsibility for any product returned without an RMA.  SkipCheks, customized units, or units that have been used, scratched, or damaged in any way will not be accepted for credit.

Units accepted for return would fall under the following classes:

  1. Units returned within 20 calendar days from ship date.
    Restock charge: 10% or minimum of $10.00 per unit.
    Reason: Nominal charge to cover cost of order processing, shipping, paperwork preparation, retesting, etc.
  2. Units returned within 45 calendar days from ship date.
    Restock charge: 25%.
    Reason: Same as above plus cost for partial disassembly, leakproof recertification, and retesting.
  3. Units returned over 45 calendar days from ship date.
    Restock charge: 50%.
    Reason: Units out of our plant this long (for any reason) must be completely disassembled for replacement of all seals and wear parts, reassembled and retested.

No units will be accepted after 6 months from the original ship date.

Deschner Corporation reserves the right to inspect all units before accepting their return and authorizing credit.

The return date is the date that the unit is received at the Deschner facility. All returned goods must be packaged securely to prevent any damage in transit. The Customer assumes all risks for loss or damage in transit and is responsible for shipping charges both ways.
